Petition for the Imposition of Antidumping Duties on Imports of Low Melt Polyester Staple Fiber from the Republic of Korea and Taiwan - Grunfeld, Desiderio, Lebowitz, Silverman & Klestadt LLP

I. Type of Action: Antidumping Duty (“AD”): Republic of Korea and Taiwan II. Product: The merchandise subject to this proceeding is synthetic staple fibers, not carded or combed, specifically bi-component polyester fibers having a polyester fiber component that melts at a lower temperature than the other polyester fiber component, used for bonding fibers together (“low melt PSF"). The scope includes bi-component polyester staple fibers of any denier or cut length. The subject merchandise may be coated, usually with a finish or dye, or not coated.

The following merchandise is excluded from the scope: (1) polyester staple fiber equal to or greater than 3.3 decitex (greater than 3 denier, inclusive) that are not bi-component fiber, currently classifiable in the Harmonized Tariff Schedule of the United States at subheadings 5503.20.0045 and5503.20.0065; (2) polyester staple fiber of less than 3.3 decitex (less than 3 denier) that are not bicomponent fiber, currently classifiable in the Harmonized Tariff Schedule of the United States at subheadings 5503.20.0025.

III. HTS classifications: Low melt PSF is classifiable under the HTSUS subheading 5503.20.0015. Although the HTSUS subheadings are provided for convenience and customs purposes, the written description of the merchandise under the order is dispositive.

Petition for the Imposition of Antidumping Duties on Imports of Certain Tapered Roller Bearings from the Republic of Korea - Grunfeld, Desiderio, Lebowitz, Silverman & Klestadt LLP

I. Type of Action: Antidumping Duty (“AD”): Republic of Korea.

II. Product: The scope of this investigation covers certain tapered roller bearings with a nominal outside cup diameter of eight inches and under, regardless of type of steel, whether of inch or metric size, and whether made of through-hardened steel or case hardened (case-carburized) steel. Certain tapered roller bearings include: finished cup and cone assemblies entering as a set, finished cone assemblies entering separately, and finished parts (cups, cones, and tapered rollers). Certain tapered roller bearings are sold individually as sets (cup and cone assembly), as a cone assembly, as a finished cup, or packaged as a kit with one or several tapered roller bearings, a seal, and grease. Certain tapered roller bearings can be a single row or multiple rows (e.g., two- or four-row), and a cup can handle a single cone assembly or multiple cone assemblies. Included in the scope are thrust bearings. The scope of this investigation does not include unfinished parts of tapered roller bearings (cups, cones, and tapered rollers) and does not include cages, whether finished or unfinished. As noted above, the scope does not include tapered roller bearing wheel hub units, railroad bearings, and other housed tapered roller bearings (flange, take up cartridges, and hanger units incorporating tapered rollers). Tapered roller bearings that have a nominal outer cup diameter of eight inches and under that are used in wheel hub units, railroad bearings, or other housed bearings, but entered separately, are included in the scope to the same extent as described above. All tapered roller bearings meeting the written description above are included, regardless of coating.

III. HTS classifications: Tapered roller bearings subject to this investigation are primarily classifiable under subheadings 8482.20.0040, 8482.20.0061, 8482.20.0070, 8482.20.0081, 8482.91.0050, 8482.99.1550, and 8482.99.1580 of the Harmonized Tariff Schedule of the United States (“HTSUS”). Parts may also enter under 8482.99.4500. While the HTSUS subheadings are provided for convenience and for customs purposes, the written description of the subject merchandise is dispositive.

TMF at Ports of LA and Long Beach to Increase 2.3% on August 1, 2017 - PierPass

LONG BEACH, Calif., June 27, 2017 – The West Coast MTO Agreement (WCMTOA) today announced that on August 1, 2017, the Traffic Mitigation Fee (TMF) at the Ports of Los Angeles and Long Beach will increase by 2.3 percent. The adjustment matches the combined 2.3 percent increase in longshore wage and assessment rates that take effect on July 1.

Beginning August 1, the TMF will be $72.09 per TEU (twenty-foot equivalent unit) or $144.18 per forty-foot container. The TMF is charged only on containers that are moved between 3:00 a.m. and 6:00 p.m. on weekdays. No TMF is due  for containers moved during OffPeak shifts (6:00 p.m. to 3:00 a.m. on weekdays or 8:00 a.m. to 5:00 p.m. on Saturdays).

OffPeak provides these regular night and Saturday work shifts to handle trucks delivering and picking up containers at the 13 container terminals in the two adjacent ports. PierPass launched the OffPeak program in 2005 to reduce severe cargo-related congestion and air pollution on local streets and highways around the Los Angeles and Long Beach ports. Nearly half of all port truck trips now take place during the OffPeak shifts.

Using a congestion pricing model, PierPass charges a TMF on weekday daytime cargo moves to incentivize cargo owners to use the OffPeak shifts. The TMF also helps offset the cost of operating extended gate hours. Labor costs are the largest single component of extended gate costs.

According to an analysis by maritime industry consultants SC Analytics, the net costs incurred by the terminals to operate the OffPeak shifts in 2016 totaled $224.7 million. During that year, the terminals received $182.7 million from the TMF, offsetting about 81 percent of the OffPeak program’s costs.

FDA Tackles Drug Competition to Improve Patient Access - Food & Drug Administration

Today, the U.S. Food and Drug Administration is taking two new, important steps to increase competition in the market for prescription drugs and facilitate entry of lower-cost alternatives. The agency published a list of off-patent, off-exclusivity branded drugs without approved generics, and also implemented, for the first time, a new policy to expedite the review of generic drug applications where competition is limited.

These actions are among the first taken under the agency’s Drug Competition Action Plan, announced by FDA Commissioner Scott Gottlieb in late May.

“No patient should be priced out of the medicines they need, and as an agency dedicated to promoting public health, we must do our part to help patients get access to the treatments they require,” said FDA Commissioner Scott Gottlieb, M.D. “Getting safe and effective generic products to market in an efficient way, being risk-based in our own work and making sure our rules aren’t used to create obstacles to new competition can all help make sure that patients have access to more lower-cost options.”

To encourage generic drug development, the FDA posted a list of branded drugs that have no listed patents or exclusivities and for which the agency has yet to approve a generic drug application (known as an Abbreviated New Drug Application or ANDA). The agency also intends to expedite the review of any generic drug application for a product on this list to ensure that they come to market as expeditiously as possible. The FDA will continue to refine and update the list periodically to ensure continued transparency around drug categories where increased competition has the potential to provide significant benefit to patients.

The FDA is also announcing a change to its policy on how the agency prioritizes its review of generic drug applications. The FDA will expedite the review of generic drug applications until there are three approved generics for a given drug product. The agency is revising the policy based on data that indicate that consumers see significant price reductions when there are multiple FDA-approved generics available.

These actions follow closely the FDA’s announcement of a public meeting to be held on July 18, 2017, to solicit input on places where the FDA’s rules – including the standards and procedures related to generic drug approvals – are being used in ways that may create obstacles to generic access, instead of ensuring the vigorous competition Congress intended.

“I am committed to continuing to pursue additional policy steps, under the FDA’s current authority, to help reduce the burden on patients who have a difficult time paying for the medicines they need,” continued Commissioner Gottlieb.

These are the first of a series of steps the agency intends to take to help tackle this important issue. The agency will unveil additional aspects of this plan in the near future and will continue to communicate with the public as additional elements of this plan are implemented.

These actions reflect the administration’s broader work to improve access to prescription drugs.

The agency also is responsible for the safety and security of our nation’s food supply, cosmetics, dietary supplements, products that give off electronic radiation, and for regulating tobacco products.


Port of NY & NJ Welcomes Zim Antwerp - Breaking Waves

The Zim Antwerp, one of the largest vessels deployed by Zim American Integrated Shipping Services (Zim) reached its berth at Maher Terminals on June 26, 2017.

The Antwerp has a maximum capacity of 10,062 TEUs. Her arrival represents the first Neo Panamax Zim vessel to call Maher Terminals in Newark Bay after a navigational clearance of 215 feet above the waterline was announced for the Bayonne Bridge earlier this month.

Ships of the Antwerp’s size and larger will become regular visitors to ocean terminals at the Port of New York and New Jersey. Two of the Antwerp’s sister ships, the Zim Rotterdam and the Zim Djibouti, will arrive later this year as part of the “ZCP” service that Zim operates from Asia.

Andrew Saporito, Deputy Director of the Port Department for The Port Authority of New York and New Jerse, joined Gary Cross, President of Maher Terminals, and George Goldman, President of Zim American, in presenting a commemorative plaque to Captain Paniec of the Antwerp.

Zim ships have been calling the Port of New York and New Jersey for more than 65 years. The company’s “ ZCP” service has called Maher since the early 1970s.
